Terms and Conditions

1. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:
- Service:The Postivo platform, including the website at postivo.app, all web applications, APIs, analysis tools, and related features provided by Postivo.
- User / Customer:Any individual or entity that accesses or uses the Service, whether on a free or paid plan.
- Content:Any images, videos, captions, text, or other materials uploaded by the User to the Service for analysis.
- Analysis Output:The results, scores, feedback, suggestions, and data generated by the Service in response to User Content.
- Postivo Score:The proprietary 0–100 composite score generated by the Service to assess predicted content performance.
- Subscription Plan:The tier of Service access selected by the User, including Free, Pro, and Agency plans.
- Early Access:A limited promotional programme available to the first 200 registered users, granting 50 free analyses.
2. Acceptance of Terms
By accessing or using the Service, you agree to be legally bound by these Terms and Conditions in their entirety. If you do not agree, you must immediately cease use of the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.
Your continued use of the Service following any modification to these Terms constitutes your acceptance of the revised Terms.
3. Account Registration and Security
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorised use of your account by contacting legal@postivo.app.
Postivo reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to the security or integrity of the Service.
4. Subscription, Payment, and Billing
4.1 Plans
The following Subscription Plans are available:
- Free: 3 analyses per calendar month at no charge.
- Pro: Unlimited analyses at $29.00/month or $23.00/month billed annually.
- Agency: Unlimited analyses with team and workspace features at $99.00/month or $79.00/month billed annually.
- Early Access: The first 200 registered users receive 50 free analyses as part of a limited promotional programme. Early Access credits are non-transferable and expire 12 months from the date of account creation.
4.2 Payment Processing
All payments are processed securely by Stripe, Inc. Postivo does not store your payment card details. By providing payment information, you authorise Stripe to charge your chosen payment method for the applicable Subscription Plan fees.
4.3 Automatic Renewal
Paid subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date. You will be charged the then-current rate at renewal.
4.4 Annual Plans
Annual plans are billed upfront for the full 12-month period and receive a 20% discount compared to the monthly rate. Annual payments are non-refundable after the 14-day refund window described in Section 4.6.
4.5 Pricing and Taxes
All prices are stated in US Dollars (USD) and exclude applicable taxes. VAT, GST, or other indirect taxes may apply depending on your jurisdiction and will be added at checkout where required by law.
4.6 Refund Policy
You may request a full refund within 14 days of your initial purchase or upgrade, provided that you have used no more than 10 analyses during that period. The following are not eligible for refunds:
- Subscription renewals
- Plan downgrades
- Annual plan purchases after the 14-day window
To request a refund, contact legal@postivo.app with your account email and reason for the request.
4.7 Cancellation
You may cancel your subscription at any time via your account Settings or through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing cycle, and you will retain access to paid features until that date.
5. License and Permitted Use
Subject to your compliance with these Terms, Postivo grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own internal business or personal purposes.
You agree not to:
- Reverse-engineer, decompile, or disassemble any part of the Service;
- Resell, sublicence, or otherwise commercialise access to the Service;
- Use automated bots, scrapers, or scripts to access the Service;
- Circumvent any usage limits, access controls, or security measures;
- Use the Service to develop a competing product or service;
- Impersonate any person or entity or misrepresent your affiliation;
- Interfere with or disrupt the integrity or performance of the Service.
6. Content and Analysis Output
6.1 User Content
You retain full ownership of all Content you upload to the Service. By uploading Content, you grant Postivo a limited, non-exclusive, royalty-free licence to process, store, and transmit your Content solely for the purpose of providing the Service. Postivo will not use your Content for training AI models or for any purpose beyond Service delivery.
6.2 Analysis Output
Analysis Output is provided for informational purposes only. You own all Analysis Output generated from your Content. Postivo does not guarantee the accuracy, completeness, or fitness for purpose of any Analysis Output. Real-world content performance depends on many factors outside the control of the Service.
6.3 Content Restrictions
You may not upload Content that:
- Infringes the intellectual property rights of any third party;
- Is unlawful, defamatory, obscene, or otherwise objectionable;
- Depicts or exploits minors in any way;
- Contains malware, viruses, or other harmful code.
7. Agency Plan
The Agency Subscription Plan includes access for up to 5 team members and up to 10 client workspaces. Seat and workspace limits may be updated with prior notice.
White-label functionality is planned for a future phase (Phase 2) of the Service and is not currently available. Postivo makes no binding commitment regarding the release date of white-label features.
8. Data Protection and Privacy
Postivo is committed to protecting your personal data in accordance with applicable data protection law, including the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the Turkish Personal Data Protection Law (KVKK).
We do not knowingly collect or process personal data from individuals under the age of 16.
Payment data is handled exclusively by Stripe and is not stored on Postivo systems.

9. Prohibited Uses of AI Features
The AI-powered features of the Service must not be used to:
- Create or promote deepfakes or synthetic media designed to deceive;
- Generate, analyse, or distribute hate speech, harassment, or discriminatory content;
- Infringe the intellectual property rights of any third party;
- Produce or disseminate disinformation or deliberately misleading content;
- Violate any applicable law or regulation in your jurisdiction.
10. Intellectual Property
All intellectual property rights in the Service, including but not limited to the software, algorithms, design, user interface, documentation, and branding, are owned by or licensed to Postivo.
The names "Postivo" and "Postivo Score" are trademarks of Postivo. You may not use these marks without prior written consent.
11. Service Availability
Postivo does not guarantee uninterrupted or error-free operation of the Service. We may perform scheduled or emergency maintenance at any time.
Where reasonably practicable, we will provide advance notice of planned downtime via the website or registered email address.
12. Third-Party Services
The Service integrates with third-party providers including Stripe (payment processing), AI model providers (content analysis), and cloud hosting providers. These services are governed by their own terms and privacy policies.
Postivo is not responsible for the availability, accuracy, or actions of any third-party service provider.
13. Termination
Postivo may suspend or terminate your account immediately and without notice if you breach these Terms, engage in fraudulent or abusive behaviour, or pose a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. Data associated with your account will be retained in accordance with applicable law and our Privacy Policy.
You may request termination of your account at any time by contacting legal@postivo.app.
14. Indemnification
You agree to indemnify, defend, and hold harmless Postivo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your Content, or your violation of these Terms.
15. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Postivo makes no warranty regarding the accuracy of Postivo Scores or Analysis Output. The predicted performance of content is indicative only. Real-world results depend on platform algorithms, audience behaviour, timing, and many other factors beyond Postivo's control.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Postivo's total liability to you for any claims arising under or in connection with these Terms shall not exceed the amounts paid by you to Postivo in the 12 months preceding the claim, or $100.00 USD, whichever is greater.
In no event shall Postivo be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, even if advised of the possibility of such damages.
17. Force Majeure
Postivo shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, cyberattacks, pandemics, acts of government, power failures, or failures of third-party infrastructure providers.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
Nothing in this clause shall limit the rights of Users located in the European Union or United Kingdom to the mandatory consumer protections afforded by the law of their country of residence.
19. Export Compliance
You agree to comply with all applicable export control and trade sanctions laws and regulations in connection with your use of the Service, including those of the United States, the European Union, and the United Kingdom.
20. Changes to Terms
Postivo reserves the right to update these Terms at any time. The current version will always be available at postivo.app/terms.
Where changes are material, we will provide at least 14 days' notice by email to your registered address before the updated Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
21. Entire Agreement
These Terms and Conditions, together with the Privacy Policy at postivo.app/privacy, constitute the entire agreement between you and Postivo with respect to the Service and supersede all prior agreements, representations, and understandings.
